Difference Between Civil Law and Criminal Law

Normally Civil Law is termed as FOJDARI and Criminal Law is called as Dewani in Pakistan and India. These two terms has their background and significance. During the regime of Mughals in sub continent,  the Mughals introduced two different departments to deal with the respective departments. They distiguished criminal law from that of civil law. The department dealing with the civil cases was termed as Dewani and its head was called as DIWAN. The department dealing with the ciminal cases was named as Fojdari and its head was named as FOJDAR. The offence against the state comes in the ambit of criminal cases.Mens Rea and Actus Reus is the most important element to constitute an offence.
